PLAY SOLANA - LIMITED WARRANTY

This Limited Warranty (the “Warranty”) is provided by Play Solana LTD, incorporated under the laws of the Ras Al Khaimah Digital Assets Oasis (RAK DAO), United Arab Emirates, with its registered office at RAK DAO Business Centre, Al Rifaa, Sheikh Mohammed Bin Zayed Road, Ras Al Khaimah, United Arab Emirates (“Play Solana”, “we”, “us”, “our”).
IMPORTANT NOTICE – PLEASE READ CAREFULLY:
THIS WARRANTY APPLIES ONLY TO GENUINE PLAY SOLANA PSG1 HARDWARE DEVICES PURCHASED DIRECTLY FROM PLAY SOLANA OR FROM AN AUTHORISED RESELLER. THIS WARRANTY IS PERSONAL TO THE ORIGINAL PURCHASER AND IS NON-TRANSFERABLE, EXCEPT WHERE TRANSFER IS REQUIRED BY MANDATORY CONSUMER LAW. THIS WARRANTY COVERS HARDWARE DEFECTS ONLY. IT DOES NOT COVER SOFTWARE, SERVICES, DIGITAL ASSETS, PRIVATE KEYS, SEED PHRASES, WALLET CREDENTIALS, OR THIRD-PARTY PRODUCTS OR ACCESSORIES, EVEN IF PACKAGED OR SOLD WITH THE DEVICE. PLAY SOLANA DOES NOT GENERATE, STORE, OR RECOVER PRIVATE KEYS OR SEED PHRASES. BLOCKCHAIN TRANSACTIONS ARE IRREVERSIBLE AND OUTSIDE OUR CONTROL.
This Warranty is a voluntary manufacturer’s warranty. IT GRANTS YOU RIGHTS IN ADDITION TO, AND SEPARATE FROM, YOUR NON-WAIVABLE STATUTORY RIGHTS UNDER APPLICABLE LAW (INCLUDING EU/UK LEGAL CONFORMITY RULES, U.S. FEDERAL/STATE CONSUMER LAWS, BRAZIL’S CONSUMER DEFENSE CODE (CDC), AND OTHER MANDATORY CONSUMER PROTECTIONS). NOTHING IN THIS WARRANTY LIMITS OR EXCLUDES YOUR STATUTORY CONSUMER RIGHTS. YOU MAY ALWAYS CHOOSE TO RELY ON THOSE STATUTORY RIGHTS RATHER THAN THIS WARRANTY.
This Warranty must be read together with our Terms of Service (Site & Store) and Terms of Use (Device & Software). TO THE EXTENT PERMITTED BY LAW, AND WITHOUT PREJUDICE TO MANDATORY CONSUMER PROTECTIONS, THIS WARRANTY GOVERNS THE SPECIFIC SUBJECT MATTER OF HARDWARE WARRANTY COVERAGE FOR THE PSG1 DEVICE. Issues of governing law, jurisdiction, and dispute resolution are as set out in the “Governing Law and Miscellaneous” section of this Warranty and are aligned with our Terms of Service.
Play Solana may require proof of purchase and/or delivery to confirm eligibility and may refuse coverage for devices purchased from unauthorised sellers, or where serial numbers, labels, or tamper-evident seals are removed, altered, or defaced. FOR WARRANTY ASSISTANCE, CONTACT legal@playsolana.com.
1. SCOPE OF THE LIMITED WARRANTY
1.1. General Coverage. This Warranty applies exclusively to PSG1 hardware devices (“Device”) manufactured and sold by Play Solana Ltd. IT COVERS ONLY DEFECTS IN MATERIALS AND WORKMANSHIP THAT MANIFEST DURING NORMAL AND INTENDED USE OF THE DEVICE, PROVIDED THAT THE DEVICE HAS BEEN USED STRICTLY IN ACCORDANCE WITH PLAY SOLANA’S OFFICIAL USER MANUALS, FIRMWARE REQUIREMENTS, SAFETY INSTRUCTIONS, AND TECHNICAL SPECIFICATIONS, AS UPDATED FROM TIME TO TIME (COLLECTIVELY, THE “INSTRUCTIONS”).
1.2. Definition of a Covered Defect. A “Covered Defect” under this Warranty exists only where:
(a) it arises and is reported to Play Solana within the Warranty Period defined in Section 2; and
(b) it materially prevents the Device from performing the essential functions expressly described in the Instructions (“Warranted Performance”).
1.3. What Is Not a Covered Defect. The following do not, in themselves, constitute defects covered by this Warranty:
dissatisfaction with the Device’s features, design, or user experience;
incompatibility with hardware, software, or services not expressly declared compatible by Play Solana;
unmet personal preferences, subjective expectations, or perceived value of the Device.
1.4. Voluntary Manufacturer’s Warranty. This Warranty is a voluntary manufacturer’s warranty. IT APPLIES IN ADDITION TO, AND SEPARATELY FROM, ANY NON-WAIVABLE RIGHTS YOU MAY HAVE UNDER APPLICABLE CONSUMER PROTECTION, PRODUCT LIABILITY, OR RIGHT-TO-REPAIR LAWS. YOU MAY ALWAYS CHOOSE TO RELY ON THOSE STATUTORY RIGHTS INSTEAD OF THIS WARRANTY.
1.5. Preservation of Statutory Consumer Rights. NOTHING IN THIS WARRANTY SHALL EXCLUDE OR LIMIT YOUR STATUTORY RIGHTS, INCLUDING BUT NOT LIMITED TO:
European Union and United Kingdom. A legal conformity warranty of two (2) years from the date of delivery, under Directive (EU) 2019/771 and the UK Consumer Rights Act 2015. Consumers may demand repair or replacement free of charge, and if those are impossible or disproportionate, may request a price reduction or rescission of the contract.
United States. Rights under the Magnuson–Moss Warranty Act and state warranty laws, including state-specific rules on implied warranties and exclusion of consequential damages.
Brazil. Rights under the Brazilian Consumer Defence Code (Código de Defesa do Consumidor – CDC), including deadlines for repair and replacement.
China. Rights under the PRC Consumer Rights Protection Law and obligations for after-sales service under the Personal Information Protection Law (PIPL).
Other Jurisdictions. Any mandatory rights granted by local consumer protection, product liability, or right-to-repair legislation, including longer warranty periods or prohibitions on exclusions.
1.6. Hardware-Only Coverage. This Warranty applies only to the Device hardware as originally manufactured and supplied. IT DOES NOT EXTEND TO:
(a) software, operating systems, applications, or services (whether pre-installed, downloaded, or third-party);
(b) the storage, recovery, security, or transfer of data, private keys, seed phrases, or wallet credentials;
(c) blockchain transactions initiated, confirmed, or displayed via the Device;
(d) accessories, peripherals, consumables, or modifications, whether or not sold or packaged with the Device.
1.7. Blockchain and Security Disclaimer. PLAY SOLANA DOES NOT GENERATE, STORE, ACCESS, OR RECOVER YOUR PRIVATE KEYS, SEED PHRASES, OR WALLET CREDENTIALS. YOU ARE SOLELY RESPONSIBLE FOR SAFEGUARDING SUCH INFORMATION. BLOCKCHAIN TRANSACTIONS ARE IRREVERSIBLE AND OUTSIDE THE CONTROL OF PLAY SOLANA. NO WARRANTY IS PROVIDED AS TO THE SECURITY, VALIDITY, LEGALITY, OR REVERSIBILITY OF ANY TRANSACTION.
2. WARRANTY PERIOD
2.1. Standard Period. UNLESS A LONGER PERIOD IS REQUIRED BY APPLICABLE LAW, THIS WARRANTY IS VALID FOR ONE (1) YEAR FROM THE DATE OF ORIGINAL DELIVERY OF THE DEVICE TO YOU, AS EVIDENCED BY VALID PROOF OF PURCHASE AND/OR DELIVERY (THE “WARRANTY PERIOD”).
2.2. European Union and United Kingdom. If you purchased your Device in the EU or UK, YOU ARE ENTITLED BY LAW TO A TWO (2) YEAR STATUTORY WARRANTY OF CONFORMITY from the date of delivery, in accordance with Directive (EU) 2019/771 and the UK Consumer Rights Act 2015. THESE RIGHTS APPLY INDEPENDENTLY OF, AND IN ADDITION TO, THIS WARRANTY. Consumers in these jurisdictions may demand free repair or replacement, and if such remedies are impossible, unlawful, or disproportionate, they may seek a price reduction or termination of the contract.
2.3. United States. In the United States, the Magnuson–Moss Warranty Act and state warranty laws may extend implied warranties beyond the one-year standard period. SOME STATES DO NOT ALLOW LIMITATIONS ON THE DURATION OF IMPLIED WARRANTIES OR ON EXCLUSIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. WHERE STATE LAW PROVIDES ADDITIONAL RIGHTS, THOSE RIGHTS PREVAIL OVER THE TERMS OF THIS WARRANTY.
2.4. Brazil. In Brazil, the Consumer Defence Code (Código de Defesa do Consumidor – CDC) grants statutory warranty rights, including specific deadlines for repair or replacement. THESE RIGHTS ARE MANDATORY AND MAY, IN PRACTICE, EXTEND PROTECTION BEYOND ONE YEAR.
2.5. China. In China, statutory after-sales obligations apply under the Consumer Rights Protection Law and related regulations, which may include specific replacement or refund obligations within prescribed deadlines.
2.6. Other Jurisdictions. WHERE OTHER JURISDICTIONS IMPOSE MANDATORY MINIMUM WARRANTY PERIODS, RIGHT-TO-REPAIR RULES, OR PROHIBIT LIMITATIONS ON WARRANTY COVERAGE, SUCH PROVISIONS SHALL PREVAIL AND APPLY INSTEAD OF, OR IN ADDITION TO, THE ONE-YEAR STANDARD PERIOD.
2.7. Repairs and Replacements. If Play Solana repairs or replaces a Device under this Warranty, THE REPAIRED OR REPLACEMENT DEVICE WILL BE COVERED BY THIS WARRANTY FOR THE LONGER OF:
(a) the remainder of the original Warranty Period; or
(b) ninety (90) days from the date of delivery of the repaired or replacement Device.
2.8. Proof of Purchase and Delivery. Play Solana may require you to provide valid proof of purchase and/or delivery. CLAIMS WITHOUT SUCH PROOF MAY BE DENIED UNLESS PLAY SOLANA CAN VERIFY THE PURCHASE INDEPENDENTLY IN ITS RECORDS.
2.9. Interaction with Updates. Where a defect arises due to FAILURE TO INSTALL MANDATORY FIRMWARE OR SECURITY UPDATES ISSUED BY PLAY SOLANA, and where such updates are necessary to maintain the Device’s security and core functionality, WARRANTY COVERAGE MAY BE DENIED.
2.10. Right to Repair Disclaimer. In jurisdictions where “right to repair” laws apply, you may have the right to independent repair. HOWEVER, THIS WARRANTY DOES NOT COVER DAMAGE, DEFECTS, OR MALFUNCTIONS CAUSED BY UNAUTHORISED REPAIR, USE OF NON-GENUINE PARTS, OR MODIFICATIONS NOT APPROVED BY PLAY SOLANA.
2.11. Dead on Arrival (DOA). If a Covered Defect is reported within fourteen (14) days of delivery and Play Solana confirms a DOA condition, Play Solana will provide an expedited replacement (“advanced exchange”) where available. You must return the original Device using the packaging and pre-addressed label provided. Failure to return the original Device within fourteen (14) days of receipt of the replacement may result in a charge equal to the replacement Device MSRP.
2.12. Regional Service and Customs. Warranty service is provided on a mail-in basis. Cross-border shipments may be routed to regional service hubs. Play Solana covers return shipping on valid claims; you remain responsible for any import duties, taxes, or customs clearance applicable to the return of your Device to you, unless prohibited by Applicable Law.
3. REMEDIES
3.1. Remedies Available. If your claim is valid and accepted under this Warranty, PLAY SOLANA WILL, WITHIN A REASONABLE PERIOD OF TIME AND AT ITS SOLE DISCRETION, PROVIDE ONE OF THE FOLLOWING REMEDIES FREE OF CHARGE TO YOU:
(a) Repair. Repair the Device using new or refurbished parts that meet Play Solana’s quality standards;
(b) Replacement. Replace the Device with a new or refurbished unit of equal or greater functionality; or
(c) Refund. Refund all or part of the original purchase price paid for the Device, TAKING INTO ACCOUNT REASONABLE USAGE DURING THE WARRANTY PERIOD.
3.2. Regional Variations. The remedies described above are subject to mandatory variations under Applicable Law, including but not limited to:
European Union and United Kingdom. Consumers are entitled to repair or replacement as the first remedy. If repair or replacement is impossible, unlawful, or disproportionate, consumers may demand a price reduction or rescission of the sales contract. ALL REMEDIES MUST BE PROVIDED FREE OF CHARGE AND WITHIN A REASONABLE TIME.
United States. Remedies are subject to the Magnuson–Moss Warranty Act and state laws. SOME STATES REQUIRE THAT REPAIR OR REPLACEMENT BE ATTEMPTED BEFORE REFUND, AND SOME DO NOT ALLOW EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. In such cases, STATE LAW SHALL PREVAIL.
Brazil. Under the Consumer Defence Code (CDC), Play Solana must repair defects within thirty (30) days. IF NOT REPAIRED IN THAT TIMEFRAME, CONSUMERS MAY DEMAND A REPLACEMENT, REFUND, OR PROPORTIONAL REDUCTION OF THE PRICE.
China. Statutory remedies apply under the PRC Consumer Rights Protection Law, including replacement or refund obligations within defined deadlines.
Other Jurisdictions. ANY MANDATORY RULES ON REMEDIES, TIMELINES, OR ORDER OF PREFERENCE IMPOSED BY LOCAL CONSUMER LAW WILL PREVAIL OVER THE TERMS OF THIS WARRANTY.
3.3. Shipping and Handling Costs. Where Play Solana elects to repair or replace a Device, PLAY SOLANA WILL BEAR REASONABLE SHIPPING AND HANDLING COSTS FOR RETURNING THE REPAIRED OR REPLACEMENT DEVICE TO YOU, PROVIDED THE CLAIM IS VALID. If the claim is invalid or excluded under Section 4, YOU MAY BE REQUIRED TO PREPAY SHIPPING, INSPECTION, HANDLING, AND RETURN COSTS.
3.4. Ownership of Returned Devices. All Devices and parts replaced or refunded under this Warranty become the property of Play Solana. BY ACCEPTING A REPLACEMENT OR REFUND, YOU IRREVOCABLY TRANSFER OWNERSHIP OF THE DEFECTIVE DEVICE OR PART TO PLAY SOLANA.
3.5. Data and Digital Assets. PLAY SOLANA DOES NOT WARRANT, REPRESENT, OR GUARANTEE THAT ANY DATA OR DIGITAL ASSETS STORED ON A DEVICE WILL BE PRESERVED, RECOVERED, OR TRANSFERRED. YOU ARE SOLELY RESPONSIBLE FOR:
backing up all data prior to submitting a warranty claim;
safeguarding your private keys, seed phrases, and wallet credentials;
ensuring that no personal or confidential information remains on the Device prior to return.
Returned Devices may be reformatted, wiped, or destroyed. PLAY SOLANA HAS NO LIABILITY FOR LOSS, CORRUPTION, OR DISCLOSURE OF DATA OR DIGITAL ASSETS IN CONNECTION WITH ANY REMEDY UNDER THIS WARRANTY.
3.6. Timeframes. Play Solana will act within commercially reasonable timeframes to process warranty claims and provide remedies. NO SPECIFIC TURNAROUND TIME IS GUARANTEED, EXCEPT WHERE MANDATORY STATUTORY DEADLINES APPLY.
3.7. Remedies are Exclusive. THE REMEDIES DESCRIBED IN THIS SECTION ARE THE SOLE AND EXCLUSIVE REMEDIES AVAILABLE UNDER THIS WARRANTY, SUBJECT ALWAYS TO YOUR MANDATORY STATUTORY RIGHTS.
4. EXCLUSIONS AND LIMITATIONS
4.1. General Rule. This Warranty covers ONLY DEFECTS IN MATERIALS AND WORKMANSHIP OF THE DEVICE UNDER NORMAL AND INTENDED USE IN ACCORDANCE WITH THE INSTRUCTIONS. IT DOES NOT APPLY TO ANY OTHER DEFECT, DAMAGE, MALFUNCTION, OR FAILURE, REGARDLESS OF CAUSE, EXCEPT AS EXPRESSLY SET OUT HEREIN.
4.2. Software, Firmware, and Services. This Warranty does not extend to:
any software, firmware, operating system, application, or service, whether pre-installed on the Device, provided by Play Solana, or downloaded from third parties;
malfunctions caused by modification, updates, or termination of third-party services or applications;
your access to or use of networks, servers, or online services, including interruptions or incompatibility.
YOUR RIGHTS IN RESPECT OF SUCH SOFTWARE OR SERVICES ARE GOVERNED EXCLUSIVELY BY THE APPLICABLE LICENSE AGREEMENTS AND TERMS OF SERVICE.
4.3. Data, Credentials, and Digital Assets. This Warranty does not cover:
any loss, theft, corruption, compromise, or disclosure of data;
any compromise, loss, or irrecoverability of private keys, seed phrases, or wallet credentials;
any blockchain transactions (including failed, invalid, reversed, disputed, or fraudulent transactions).
PLAY SOLANA DOES NOT GENERATE, STORE, OR RECOVER PRIVATE KEYS OR SEED PHRASES. YOU ARE SOLELY RESPONSIBLE FOR SAFEGUARDING THEM. BLOCKCHAIN TRANSACTIONS ARE IRREVERSIBLE AND OUTSIDE OUR CONTROL.
4.4. Consumables, Cosmetic Damage, and Normal Wear. Excluded from coverage are:
ordinary wear and tear (including scratches, dents, abrasions, discoloration, fading, or other minor cosmetic changes);
consumable components (including batteries, UNLESS DEFECTIVE IN MATERIALS OR WORKMANSHIP);
natural depletion of battery capacity over time;
cosmetic imperfections that do not materially affect Device performance.
Battery Health Standard. Degradation of battery capacity over time is expected. A battery retaining less than eighty percent (80%) of its original capacity within the first twelve (12) months, under normal use and charging, will be deemed a Covered Defect.
Pixel Policy. Minor pixel anomalies that are within industry-standard tolerances do not constitute a Covered Defect. A display exhibiting pixel defects beyond Play Solana’s published tolerance thresholds will be deemed defective.
4.5. Accidental Damage and Environmental Exposure. This Warranty does not cover damage arising from:
accidental impact, shock, or crushing;
exposure to liquid, food, sand, dust, or other contaminants;
fire, smoke, explosions, or overheating;
extreme environmental conditions, including excessive temperature, humidity, radiation, or magnetic/electromagnetic interference;
static discharge, electrical surge, or unstable power supply.
4.6. Intentional Misuse or Abuse. This Warranty excludes damage caused by intentional acts, including:
deliberate tampering, dismantling, or destruction of the Device;
bypassing or attempting to bypass security features;
overclocking, forced modifications, or misuse outside the intended purpose of the Device.
4.7. Unauthorised Repairs or Modifications. Excluded are:
Devices opened, altered, repaired, or disassembled by anyone other than Play Solana or an authorised service provider;
installation or use of non-genuine or non-approved parts, accessories, or batteries;
modifications, alterations, or customisations (hardware or software) not expressly approved by Play Solana.
4.8. Incompatibility. This Warranty does not cover defects, malfunctions, or performance issues arising from:
use of the Device with hardware, software, services, or accessories not expressly declared compatible in the Instructions;
attempts to connect, integrate, or operate the Device with unauthorised blockchain networks, wallets, or decentralised applications (dApps);
use of the Device with counterfeit, modified, or uncertified power supplies, chargers, or cables.
4.9. Failure to Install Updates. Coverage under this Warranty may be denied where:
the claimed defect results from FAILURE TO INSTALL MANDATORY FIRMWARE OR SECURITY UPDATES PROVIDED BY PLAY SOLANA;
such updates were necessary to maintain Device security, interoperability, or functionality;
the failure to update was within the consumer’s reasonable control.
4.10. Illegal or Prohibited Use. This Warranty excludes any defect, damage, or malfunction resulting from:
use of the Device in violation of applicable law or regulation;
use in embargoed jurisdictions or in circumvention of trade or export restrictions;
use of the Device to facilitate unlawful blockchain transactions, INCLUDING TRANSACTIONS LINKED TO SANCTIONED ENTITIES, MONEY LAUNDERING, OR OTHER ILLICIT ACTIVITY;
attempts to disable or bypass safety, compliance, or security controls.
4.11. Theft, Fraud, and Security Measures. This Warranty does not apply to:
Devices reported as stolen to Play Solana, resellers, or competent authorities;
Devices where ownership cannot be verified due to missing or invalid proof of purchase;
Devices locked by passcode, PIN, or other security features that cannot be deactivated by presenting valid proof of purchase and identity;
fraudulent or bad-faith warranty claims.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, PLAY SOLANA MAY PROVIDE DEVICE IDENTIFIER INFORMATION (SUCH AS IMEI, SERIAL NUMBER, OR HARDWARE ID) TO LAW ENFORCEMENT OR FRAUD PREVENTION REGISTRIES.
4.12. Unauthorised or Grey-Market Sales. This Warranty does not cover:
Devices purchased from unauthorised resellers, second-hand vendors, or “grey market” distributors;
Devices where serial numbers, IMEIs, barcodes, or labels have been altered, defaced, or removed;
incomplete Devices returned without essential components (e.g., external covers, integrated accessories), WHERE THE ABSENCE MATERIALLY PREVENTS INSPECTION OR REPAIR.
4.13. Expectations vs. Warranted Performance. If the Device operates in accordance with the Instructions and delivers the Warranted Performance, IT SHALL NOT BE CONSIDERED DEFECTIVE EVEN IF:
it does not meet your personal preferences, expectations, or desired features;
it does not interoperate with other devices, applications, or services not expressly declared compatible by Play Solana.
4.14. Force Majeure and External Events. This Warranty excludes any defect or damage caused by events outside Play Solana’s reasonable control, including but not limited to:
natural disasters such as floods, earthquakes, storms, or lightning;
war, terrorism, civil unrest, embargoes, or government actions;
strikes, labour disputes, or supply chain disruptions beyond Play Solana’s control.
4.15. Mandatory Legal Carve-Outs. NOTHING IN THIS SECTION SHALL OPERATE TO EXCLUDE OR LIMIT LIABILITY WHERE SUCH LIMITATION IS PROHIBITED BY LAW. This includes, without limitation:
liability for death or personal injury caused by Play Solana’s negligence;
liability for fraud or fraudulent misrepresentation;
mandatory consumer protection rights, INCLUDING THE EU/UK TWO-YEAR CONFORMITY GUARANTEE, U.S. STATE-SPECIFIC RIGHTS ON IMPLIED WARRANTIES AND DAMAGES, THE BRAZILIAN CDC, THE CHINESE CRPL, AND EQUIVALENT PROTECTIONS IN OTHER JURISDICTIONS.
5. HOW TO MAKE A CLAIM
5.1. Initiating a Claim. To obtain service under this Warranty, you must submit a claim during the Warranty Period by contacting Play Solana at legal@playsolana.com or by using the dedicated forms available through our compliance hub at playsolana.com/psg1-warranty. A valid claim must include proof of purchase (such as invoice or receipt) and, where applicable, proof of delivery; the Device’s serial number, IMEI, or other identifying information; a written description of the alleged defect, including the circumstances in which it arose; and confirmation that the Device was used in accordance with the Instructions. Claims submitted without this information may be delayed or refused.
5.2. Return Authorisation. Following review of your request, Play Solana may issue a Return Merchandise Authorisation (RMA) and provide packaging and shipping instructions. DEVICES RETURNED WITHOUT AN RMA, OR WITHOUT COMPLIANCE WITH THE PROVIDED INSTRUCTIONS, MAY BE REFUSED OR DECLARED INELIGIBLE FOR COVERAGE.
5.3. Responsibility During Transit. Until Play Solana or an authorised service centre confirms receipt, YOU REMAIN RESPONSIBLE FOR THE DEVICE. PLAY SOLANA IS NOT LIABLE FOR LOSS, THEFT, DAMAGE, OR TAMPERING DURING TRANSIT IF YOU FAIL TO USE THE PRE-ADDRESSED SHIPPING LABEL OR PACKAGING PROVIDED BY PLAY SOLANA.
5.4. Inspection and Verification. Upon receipt, Play Solana will inspect and test the Device. PLAY SOLANA RESERVES THE RIGHT TO DETERMINE, ACTING REASONABLY AND SUBJECT TO APPLICABLE LAW, WHETHER THE DEFECT IS COVERED UNDER THIS WARRANTY.
5.5. Invalid or Excluded Claims. If inspection shows that:
(a) the Device is not defective; or
(b) the defect is excluded under Section 4;
then:
Play Solana may return the Device to you at your expense, AFTER PREPAYMENT OF APPLICABLE SHIPPING, HANDLING, AND INSPECTION COSTS; or
if you do not prepay, Play Solana may hold the Device for your collection for thirty (30) days, AFTER WHICH IT MAY BE SECURELY DISPOSED OF WITHOUT FURTHER LIABILITY.
5.6. Customer Cooperation. You must cooperate in good faith with Play Solana’s service and support staff, INCLUDING PROVIDING ANY ADDITIONAL INFORMATION, DOCUMENTATION, OR AUTHORISATIONS REASONABLY REQUESTED. FAILURE TO COOPERATE MAY RESULT IN DENIAL OF COVERAGE.
5.7. Costs in Case of Invalid Claims. Where a claim is found invalid or outside the scope of this Warranty, PLAY SOLANA MAY CHARGE REASONABLE COSTS FOR INSPECTION, DIAGNOSTICS, STORAGE, AND RETURN SHIPPING, UNLESS SUCH CHARGING IS PROHIBITED BY APPLICABLE LAW.
5.8. Data and Privacy During Claims. Before returning a Device, YOU MUST DELETE ALL PERSONAL INFORMATION AND DATA AND BACK UP ANY DATA YOU WISH TO RETAIN. DEVICES RETURNED UNDER THIS WARRANTY MAY BE ERASED, REFORMATTED, OR DESTROYED. PLAY SOLANA HAS NO RESPONSIBILITY FOR LOSS, EXPOSURE, OR CORRUPTION OF DATA DURING INSPECTION, REPAIR, OR REPLACEMENT.
5.9. No Waiver. ACCEPTANCE OF A DEVICE FOR INSPECTION, OR ISSUANCE OF AN RMA, DOES NOT CONSTITUTE AN ADMISSION BY PLAY SOLANA THAT THE CLAIM IS VALID. REMEDIES WILL BE PROVIDED ONLY AFTER PLAY SOLANA HAS CONFIRMED IN WRITING THAT THE DEFECT IS COVERED UNDER THIS WARRANTY.
6. LIABILITY, DISCLAIMERS, AND LIMITATIONS
6.1. Sole Remedies. Your sole and exclusive remedies under this Warranty are those expressly described in Section 3 (Repair, Replacement, Refund). Except as required by non-waivable consumer law, no other remedies shall be available, and Play Solana shall have no obligation to provide any remedy beyond those expressly stated.
6.2. Disclaimer of Warranties. To the maximum extent permitted by law, Play Solana makes no other warranties, representations, or conditions beyond this document. Without limitation, Play Solana does not warrant that the Device, its firmware, or any software will be uninterrupted, error-free, or secure, and does not warrant compatibility with any particular third-party hardware, software, or services. All implied warranties, including merchantability, fitness for a particular purpose, durability, quiet enjoyment, quality, and non-infringement, are limited in duration to the Warranty Period, unless such limitation is prohibited by Applicable Law.
6.3. Exclusion of Certain Damages. To the maximum extent permitted by law, Play Solana shall not be liable for any incidental, indirect, punitive, exemplary, or consequential damages of any kind, including but not limited to loss of profits, revenue, business, contracts, goodwill, opportunity, or anticipated savings. Play Solana shall not be liable for loss, corruption, disclosure, or unauthorised access to data or digital assets, including but not limited to private keys, seed phrases, wallets, or blockchain-based assets. Play Solana shall not be liable for damages arising from cyberattacks, malware, security breaches, unauthorised third-party access, or blockchain exploits; for damages caused by use of the Device with non-approved, counterfeit, or modified hardware, software, or services; or for damages resulting from events or conditions outside Play Solana’s reasonable control, including force majeure events.
6.4. U.S. Customers. For U.S. residents, the following provisions apply. Some states do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, and in such states the above limitations may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. No implied warranty shall extend beyond the Warranty Period, except where prohibited by law. Where state law provides additional protections, such rights prevail over the terms of this Warranty.
6.5. Non-U.S. Customers. For customers outside the United States, Play Solana shall not be liable for losses not caused by breach of this Warranty and shall not be liable for losses that were not reasonably foreseeable at the time of purchase. A loss is foreseeable only if it was obvious or if both you and Play Solana knew at the time of purchase that such a loss might occur. Play Solana shall not be liable for business losses, including loss of data, business interruption, lost profits, revenues, opportunities, or contracts. Nothing in this Warranty excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded, limited, or restricted under Applicable Law, including mandatory consumer protections in your country of residence.
6.6. Aggregate Liability Cap. Except as required by Applicable Law, the maximum aggregate liability of Play Solana arising out of or relating to this Warranty, whether in contract, tort, statute, equity, or otherwise, shall not exceed the original purchase price actually paid for the Device by the original purchaser. This cap applies even if Play Solana has been advised of the possibility of such damages.
6.7. No Extension by Advice or Representation. No reseller, distributor, employee, agent, or representative of Play Solana is authorised to modify, extend, expand, or create any warranty, representation, or obligation not expressly stated in this Warranty. Any oral or written statement made outside this Warranty shall not create any binding obligation for Play Solana, and Play Solana expressly disclaims any such unauthorised commitments.
7. GOVERNING LAW AND MISCELLANEOUS
7.1. Governing Law. This Warranty, and any dispute, claim, or obligation arising out of or in connection with it, SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE UNITED ARAB EMIRATES AS APPLIED IN THE EMIRATE OF RAS AL KHAIMAH, WITHOUT REGARD TO CONFLICT-OF-LAW PRINCIPLES THAT WOULD REQUIRE THE APPLICATION OF ANOTHER JURISDICTION’S LAWS.
7.2. Consumer Jurisdiction. IF YOU ARE A CONSUMER, NOTHING IN THIS WARRANTY DEPRIVES YOU OF THE PROTECTION AFFORDED TO YOU BY MANDATORY PROVISIONS OF THE LAW OF YOUR COUNTRY OF RESIDENCE. YOU MAY BRING PROCEEDINGS IN THE COURTS OF YOUR RESIDENCE, AND PLAY SOLANA MAY BRING PROCEEDINGS AGAINST YOU ONLY IN THOSE COURTS, UNLESS YOU EXPRESSLY AGREE OTHERWISE IN WRITING. THIS SECTION PRESERVES YOUR NON-WAIVABLE STATUTORY RIGHTS.
7.3. Business Users (Arbitration). IF YOU ARE NOT A CONSUMER, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR IN CONNECTION WITH THIS WARRANTY SHALL BE FINALLY RESOLVED BY ARBITRATION UNDER THE RULES OF THE DUBAI INTERNATIONAL ARBITRATION CENTRE (DIAC), WHICH RULES ARE DEEMED INCORPORATED BY REFERENCE INTO THIS CLAUSE. THE SEAT OF ARBITRATION SHALL BE DUBAI, UNITED ARAB EMIRATES. THE LANGUAGE OF ARBITRATION SHALL BE ENGLISH. THE ARBITRAL TRIBUNAL SHALL CONSIST OF ONE ARBITRATOR, UNLESS OTHERWISE AGREED. THE ARBITRAL AWARD SHALL BE FINAL AND BINDING, AND JUDGMENT UPON THE AWARD MAY BE ENTERED IN ANY COURT OF COMPETENT JURISDICTION. NOTHING IN THIS CLAUSE PREVENTS PLAY SOLANA FROM SEEKING URGENT INJUNCTIVE, CONSERVATORY, OR EQUITABLE RELIEF IN ANY COMPETENT COURT.
7.4. Interpretation. Headings are for convenience only and have no contractual effect. Any use of the word “including” shall mean “including without limitation.” If any provision is ambiguous, it shall be interpreted consistently with Applicable Law and in favour of preserving enforceability.
7.5. Severability. Suppose any provision of this Warranty is held invalid, illegal, or unenforceable by a court or arbitral tribunal of competent jurisdiction. In that case, that provision shall be deemed modified to the minimum extent necessary to make it valid. If modification is not possible, the provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.
7.6. Amendments and Updates. EXCEPT AS PROHIBITED BY LAW, PLAY SOLANA RESERVES THE RIGHT TO AMEND OR UPDATE THIS WARRANTY FROM TIME TO TIME, INCLUDING TO REFLECT CHANGES IN LAW OR REGULATORY REQUIREMENTS. ANY SUCH UPDATES SHALL NOT AFFECT CLAIMS SUBMITTED BEFORE THE DATE OF THE UPDATE.
7.7. Assignment. This Warranty is personal to you and may not be assigned or transferred without Play Solana’s prior written consent, EXCEPT WHERE TRANSFER IS REQUIRED BY APPLICABLE CONSUMER LAW, SUCH AS AUTOMATIC TRANSFER TO A GIFT RECIPIENT IN CERTAIN JURISDICTIONS.
7.8. Entire Agreement. This Warranty constitutes the entire agreement between you and Play Solana regarding Device warranty coverage, without prejudice to statutory rights. No reseller, distributor, employee, or agent of Play Solana is authorised to extend or modify this Warranty.
7.9. Language. This Warranty may be translated into multiple languages. IN THE EVENT OF ANY DISCREPANCY OR CONFLICT BETWEEN TRANSLATIONS, THE ENGLISH VERSION SHALL PREVAIL, EXCEPT WHERE LOCAL LAW REQUIRES OTHERWISE.
